Patrick Kane - Possible rape charge

Has anyone come up with a good reason why Mom/daughter would lie about the bag?

Hysterical mother worried that the daughter she fully believes was raped isn't going to get the justice that she deserves?

Hysteria makes people do stupid things, but this blows a massive hole in her daughter's case and now that it's been made public, is probably going to taint people's perception of the accuser, justified or not.

You'd also think that the lawyer wouldn't fling sh*t at the police department before checking to make sure that what was handed to him was actually a rape kit.

Yeah, that too. Not the most professional way to handle things. It's starting to feel like he wasn't well equipped to handle such a high profile case.

And I go back to my question of what do we actually know about the guy.

I found his language somewhat telling in that he talked about having discussions with "former prosecutors and law enforement people" as opposed to "I went directly to the DA and confirmed this was the kit".

That seems like it would require some forethought.

I don't see how it blows a hole in her case.

It doesn't, unless they find evidence she was involved in it. What might blow a hole in her case is that the other girl that went home with them is now reluctant to corroborate the accuser's story and testify in court.

Well, if this indeed happens, I think the DA is going to have a problem charging Kane.

What I don't understand is how someone who has been practising law for quite some time in Erie County wouldn't know that rape kits for that area are in boxes and not bags? My best guess is that Mr. Eoannou doesn't have experience with rape cases, otherwise he would know that. The other thing is why would you hire a lawyer who isn't familiar with the type of crime at hand, in this case rape?

Keep in mind we're talking about the side that isn't representing a guy making 8 figures a year. We don't know much about the accuser here but it might be that they can't simply hire any lawyer they want.

The way he handled some of his press conferences, especially the late ones relating to the evidence bag made him seem like he was of the ambulance chaser quality of lawyer.  I mean his whole discussion on the evidence bag was centered on his discussions with "former prosecutors and law enforcement officers".  Seems like it would have been a pretty easy thing to call up the DA office and ask what the hell is going on before you run out and have a press conference to declare a travesty of justice.

Sure. But, again, they may very well be forced to only be able to hire lawyers who'll work on contingency.

Which, although this probably doesn't need repeating at this point, emphasizes how messed up this whole situation is. How many crimes are there where the Victim, even if it's just an alleged victim, needs to lawyer up? But the way this whole thing is going, with her reputation being called into question and so much of this being fought in the public sphere, it's incumbent on her to have legal representation.

Some pretty wild inconsistencies there in the claims. Makes me think that a successful prosecution even if they went ahead
despite the fake evidence bag would be nowhere near a conviction anyway.

Now Kane will cut a cheque and the incident itself will be over.

I feel really bad for the girl if something did happen and this is how it's turned out.

Equally, I feel really bad for Kane, if we're to believe what's now being said, he's had his name dragged through the mud and this case is something that he is unfortunately always likely to have associated with his name.

Kobe Bryant and Ben Roethlisberger seem to be doing just fine. In 5 years (or less) the casual fan won't have any idea this even happened.

Of course, but on a personal level, I'm sure he'll get it thrown in his face a lot and I'm sure that wouldn't be good for anyone's mental health.

Also, I don't get this kind of flippant attitude about it, maybe your comment just came off that way. Had your comment been directed at the girl who it now appears wrongly accused Kane, would that be okay too?

Sorry if I misjudged your comments intended tone.

I really don't know if I was flippant or not, I just don't think Kane deserves any sympathy. He'll be fine. And I've said all along how I feel about this regardless of if Kane actually gets charged or not (and again I've said all along he probably won't be). One of these two individuals is going to be a lot more effected by this situation for the rest of their lives and it isn't going to be Kane.

So, in these cases the accused is always guilty, no matter the outcome of criminal proceedings?
