Jared Cowen on waivers for purpose of a buyout

Can the Leafs pull an Owen Nolan with him?  And basically say "We intend to buy him out, but he's injured.  The moment he's healthy again, whenever that may be, we'd like to buy him out."

This is the way I see it, unless he plans to be injured the rest of his career, Leafs can just wait until he's "healthy" and then buy him out.

Not really, no. Not unless the arbitrator rules in their favour. If not, he has to remain on the NHL roster - though, obviously, on LTIR - until he's cleared to play, at which time, the Leafs can send him to the AHL for the remainder of the season to save a little cap space.

There are only 2 buyouts window periods and both are before the season starts.
After that, is LTIR or Regular Waivers or AHL/NHL

Only in very specific circumstances - typically only when a player has an offer to play in a European league rather than the AHL, or if the player has violated the terms of his contract.

Can we say Cowen violated the terms of his contract for promising not to suck so bad?

As busta indicated, unless the player has violated the terms of his contract I believe the player needs to agree to have his contact terminated and this usually only occurs if the player has a deal to play in Europe because he doesn't want to be buried in the AHL.

He was placed on waivers during the buyout window, though, so hopefully the arbitrator takes that into consideration.  That stinks that because he was "injured" during the that window he can't be bought out, but if he's miraculously healthy after it closes, no action can be taken.
 
The issue with Cowen is this:

-When the Leafs acquired him he was on the injured reserve with a hip injury
-After being cleared to play, the Leafs placed him on waivers and assigned him to the Marlies
-Instead of playing for the Marlies, the Leafs sent him home so he wouldn't injure himself while performing hockey activities and reportedly told him that he'll be bought out in the offseason
-After leaving Toronto, he had surgery on the advice of a doctor who wasn't employed by the Leafs

Obviously, that last point is what's causing the issue here. The Leafs medical staff felt that he was healthy. Cowen had another doctor who felt otherwise. That's the point of contention that the arbitrator will have to figure out.

Is it an either or thing?  Is it possible for him to be bought out and get the cap savings, but that Cowen could be awarded 2/3's his contract instead of the 1/3 that would happen now?

I guess what I am asking is are the only options that he will be bought out or he won't be?  Is it possible that some sort of agreement could be made where he still gets bought out, but more money could be awarded to appease the grievance?
