The way the rules around penalty shots are qualified is that the infraction has to take away a clear scoring chance - so, getting a weak shot off or not being hauled down, etc., wouldn't necessarily mean it's not a penalty shot. That play, on the other hand, wasn't even a penalty, and it definitely did not take away the scoring chance.
Exactly, that's what makes it even worse. Generally, if there's any doubt whatsoever, it's a minor penalty. The fact it wasn't even close to being a minor penalty really makes you wonder how the call could have been botched so badly.
