2018 World Junior Allegations

the OPP civilian call taker referred her to the wrong detachment and did not stay on the line - a significant error but not that sinister.

She got checked by her doctor for sexually transmitted disease the next day but didn't report it (circumstantial).
All she seems to have for incriminating evidence that has been reported is a call to a friend at the time.
I doubt that's enough for criminal charges - beyond a reasonable doubt.
They would have to flip at least one of the perpetrators (maybe one of the 16 year olds who got pressured) or get some other corroborating evidence (tough to do 10 years later).
So that is probably why the police would not assure her something could come of it criminally.

A civil case based on a preponderance of the evidence is a lower bar.
But she doesn't have as much as E Jean Carroll did - that could/might change.

Regardless, W5 is pretty credible. It's another nasty public smear of the sport.
If this woman is being truthful - which seems likely, I hope she gets the help she'll need.
Makes one wonder about how many of these we'll never hear about.

Jury has been discharged again, and the trial moves ahead as Judge-only.


The details that have been published already are very sad.

The reason for the first mistrial:
That mistrial occurred after a juror reported that a member of the court — Dudding — spoke to her at a local market during the lunch break.

Brown, Dudding’s co-counsel, told the judge that his understanding of the situation was that there was an accidental and innocuous interaction during which Dudding and the juror were next to each other in line for lunch and his colleague acknowledged the awkwardness in a benign way.

That juror, who was later called in front of the judge and attorneys, described the interaction differently, stating that Dudding spoke to her in line, and referenced there being a lot of “head-nodding” that morning. The jury had recently heard the Crown’s opening statement.

The reason for the jury dismissal:
a juror sent a note to [Judge] Carroccia on Thursday that accused two of the defense lawyers of inappropriate behavior.

The note read: “Multiple jury members feel we are being judged and made fun of by lawyers (Daniel) Brown and Hilary Dudding. Every day when we enter the courtroom they observe us, whisper to each other and turn to each other and laugh as if they are discussing our appearance. This is unprofessional and unacceptable.”

If I had a nickel every time Formenton's counsel were at the centre of some sort of jury tainting...
